This website is operated by Treasurefix LLC. Throughout the site, the terms “we”, “us” and “our” refer to Treasurefix LLC. Treasurefix LLC offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least 18 years of age or older, or the age of majority in your state or province of residence, whichever is higher; and/or that you are at least 18 years of age or older, or the age of majority in your state or province of residence, whichever is higher, and you have given us your consent to allow any of your minor dependents to use this site.You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).You must not transmit any worms or viruses or any code of a destructive nature.A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any reason at any time.You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.This site may contain certain historical information. Prices for our products are subject to change without notice.We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCTS OR SERVICES

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. SECTION 7 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

Certain content, products and Services available via our Service may include materials from third-parties.Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example, treasure hunt solve entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

SECTION 10 - PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 11 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 12 - PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

SECTION 13 - TREASURE HUNT OFFICIAL RULES & REGULATIONS

Treasurefix LLC offers various forms and modes of puzzles, games, problems, scavenger hunts, and treasure hunts (collectively, “treasure hunt(s)”) as part of our Service. This Section constitutes the “Official Rules” as pertaining to our Service, and particularly the treasure hunts that we offer as part of our Service.

To be eligible to participate in our treasure hunts, you must be 18 years of age or older (or the age of majority in your jurisdiction of residence, whichever is higher), have the power to enter a binding contract with Treasurefix LLC, and reside within the United States. A “Contestant” includes both you and all other persons participating on an individual basis with you as part of a larger group or team.

For group/team participation, the individual within such group/team who has purchased the membership for our Service shall be the “Lead Contestant” and effectively functions as the authorized representative for all members of the group/team and as the sole liaison with us as to your (and the team/group’s) participation in our Service. The Lead Contestant assumes full responsibility for informing all other persons who are members of his/her group/team of any information and materials provided by us in conjunction with participation in our Service.

A. Verification of Official Winner:

  1. The winning Contestant of a treasure hunt will be the Contestant who successfully completes the objective as defined by us within the duration as defined by us while adhering to these Official Rules and these Terms of Service. With regard to submission time, our server shall be the official clock for all treasure hunts and solve submissions. In the event of a tie, the reward shall be split evenly amongst the Contestants with identical solves and submission times. Contestants understand and agree that all information regarding the determination of the winner of a treasure hunt is confidential and proprietary to Treasurefix LLC, and waive any right or claim to review the same (unless the winning Contestant has expressly given us the right to display and/or promote his/her display name and/or other details).
  2. You must be an actively subscribed member of our Community to submit a solve attempt for our treasure hunts or attempt to locate any physical objects associated therewith. Solve submissions lacking an active, non-restricted Unique Solve ID do not qualify as recognized solve attempts and will be neither considered as qualified solve submissions nor reward-eligible. The offered reward is a legal offer that merely requires acceptance in the form of a qualified solve attempt that is first to be submitted and correct in its entirety (as verified by us). You are free to work with others and/or share elements of your solve on forums, discussion boards, or other mediums. Only the first member to submit the correct solve, however, will be legally entitled to the reward, partial or otherwise.
  3. The winning Contestant will need to verify basic information from their order to verify that they were an eligible Contestant. As part of the verification procedure, we may require a Contestant (for group/team participation, the Lead Contestant and perhaps other Contestants as well) to complete, sign and return an Affidavit of Eligibility and Release and/or provide valid government-issued photo identification. Once the winning Contestant has fully complied with the preceding requirements (as determined by us in our sole discretion), he/she will become an “Official Winner.”
  4. Payment of the reward (i.e., “Prize Money”) will be made to the Official Winner by bank transfer (or cryptocurrency transfer if requested) within thirty (30) days of determination of Official Winner status, provided that no open disputes exist pertaining to the particular treasure hunt at issue and/or the Official Winner’s status. For clarity, if the Official Winner is a group/team, the Prize Money will be paid solely to the Lead Contestant; LEAD CONTESTANT ASSUMES ANY AND ALL LIABILITY FOR DISTRIBUTION OF PRIZE MONEY AMONG CONTESTANTS COMPRISING THE GROUP/TEAM. IN NO EVENT WILL TREASUREFIX LLC PAY OUT PRIZE MONEY TO MORE THAN ONE (1) PERSON IN CONJUNCTION WITH A GIVEN CONTESTANT’S PARTICIPATION IN OUR SERVICE. THE ONLY RECOURSE FOR A CONTESTANT WHO IS A MEMBER OF GROUP/TEAM THAT QUALIFIED TO RECEIVE A REWARD IN ONE OF OUR TREASURE HUNTS IS AGAINST THE CORRESPONDING LEAD CONTESTANT. WITHOUT LIMITATION, CLAIMS RELATED TO NOT RECEIVING PRIZE MONEY FROM LEAD CONTESTANT ARE NOT ACCEPTABLE SUBJECT MATTER FOR AN OFFICIAL DISPUTE.
  5. If an Official Dispute (as defined below) is made and an inquiry opened, the payment will be made to the Official Winner within thirty (30) days of the outcome of the inquiry, provided that the inquiry determines that such Contestant is, in fact, the Official Winner. (If the inquiry determines that the Official Winner was ineligible or violated any part of these Official Rules or these Terms of Service, Treasurefix LLC will not have any liability to such Contestant under any legal theory, and a new Official Winner will be determined as set forth herein). The Official Winner will be required to have access to a bank account within the United States in order to receive Prize Money. Prize Money will only be provided to the Official Winner via bank transfer. Under no circumstances will Prize Money be made available in cash, check, money order, or other form. The Official Winner will have thirty (30) days from the date of notification of achieving such status to provide us with information for their bank account to facilitate the deposit. In the event the Official Winner is not able to provide a bank account within thirty (30) days from the date of notification of achieving such status, the Prize Money will be forfeited, Treasurefix LLC will not have any liability to such Contestant under any legal theory, and a new Official Winner will be determined as set forth herein.

B. Announcement of Official Winner:

  1. Once an Official Winner has been verified by us, an announcement of the Official Winner (i.e., the display name of the Lead Contestant/Official Winner) will be made to all Contestants through social media and/or on this Site. The display name of the Official Winner will be announced within one (1) week of our notification to the corresponding Contestant of having achieved such status.
  2. As a Contestant in any of our treasure hunts, you expressly understand and agree that we may use your display name (which you have full control over choosing) on any treasure hunts, leaderboards, or other materials that we choose to publish on this Site, on social media channels, and/or elsewhere. We reserve the right to change/delete any display names containing any words, terms, or phrases that we deem objectionable, offensive, vulgar, or otherwise inappropriate.

C. Official Disputes:

  1. If a Contestant other than the Official Winner believes that they are the rightful Official Winner, or believes that the Official Winner was ineligible or violated these Official Rules and/or these Terms of Service, a dispute may be entered by emailing info@treasurefix.com with the subject line “Official Dispute” within twenty-four (24) hours of the time at which the username of the Official Winner is announced, with time being kept by our server. Any Official Dispute not made within the form and timeline set forth herein shall be disregarded regardless of its merits.
  2. The body of the email must include all known details surrounding the dispute, and must include the name and phone number of the individual Contestant initiating the dispute. (The identity of the initiator of the dispute will be kept anonymous, unless the dispute leads to them being determined as the Official Winner. If the initiator of the dispute is deemed the Official Winner, their display name will be announced as set forth above.)
  3. Treasurefix LLC will acknowledge receipt of the Official Dispute within twenty-four (24) hours. If receipt is not acknowledged within twenty-four (24) hours, the sender of the Official Dispute should resend the email.
  4. When an Official Dispute is received, we will make an initial, preliminary determination of the credibility and potential validity of the dispute. If the dispute is deemed credible and potentially valid, an inquiry will be opened. The opening of an inquiry does not necessarily mean that we suspect any wrongdoing, but rather that we believe the matter is worth investigating. If the dispute is not deemed credible and valid, an inquiry will not be opened and the Official Dispute will be dismissed and cannot be the subject of a future Official Dispute.
  5. An inquiry may last an indefinite amount of time and consist of various methods as determined in our sole discretion. The Official Winner may be required to submit a statement or participate in a recorded interview, or otherwise cooperate by providing information and/or materials upon our request for the inquiry in order to maintain eligibility (if applicable) and for the Official Dispute to remain open. (If an inquiry involves group/team participation, the preceding requirements apply to each and every Contestant comprising the group/team.) If the Official Winner refuses any such request within ten (10) days of the request they may lose eligibility and the Official Dispute will be dismissed and cannot be the subject of a future Official Dispute. If a Contestant loses eligibility, any claim to status as an Official Winner and the attendant reward/Prize Money will be forfeited without any liability to Treasurefix LLC under any legal theory and a new Official Winner may be named.
  6. Treasurefix LLC will make a decision in the inquiry and notify all relevant parties. The decision of Treasurefix LLC regarding a given Official Dispute is final, binding and not subject to appeal. If the final decision results in a new Official Winner being determined, or a contingency being enacted to determine a new Official Winner, all Contestants will be notified.

D. Physical (i.e., “boots on the ground”) Participation:

If you choose to pursue any “boots on the ground” (or “BOTG”) element of our treasure hunts or in connection with our Service in any way, the following ground rules are always in effect:

  1. Physical items will never be hidden in a location that is dangerous to access or arrive at. Additionally, items will never be hidden in a location that requires water travel (e.g., swimming or traveling by raft, canoe, boat, etc) to access or arrive at
  2. You will never need to trespass or engage in illegal activity of any kind to access or arrive at the location of any hidden physical items. If you are engaging in illegal activity, or even thinking about it, you are not on the right path.
  3. No physical items will ever be buried under the ground. You will never need to dig up or otherwise disturb any land in any way, under any circumstances.
  4. Be mindful of the presence of wildlife (bears, snakes, etc) and hunters in any search area, and be mindful of your own physical limitations. We cannot practically cover all scenarios here, just use sound judgment at all times when it comes to when, where, and how you decide to go looking for hidden physical items. Search with a buddy whenever possible, avoid dangerous conditions, and bring plenty of water.
  5. Search areas are currently limited to locations within the continental United States.
  6. You expressly agree that your use of, or inability to use, the Service is at your sole risk. In no case shall Treasurefix LLC, our directors, officers, members, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss, injury, or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

E. Restrictions & Prohibited Conduct:

  1. In the course of participating in our treasure hunts, Contestants may encounter one another (virtually and/or physically). Verbal or physical harassment, threatening, “trash-talking,” vulgarity or other belligerent/obnoxious/anti-social behavior toward other Contestants is strictly prohibited.
  2. The treasure hunts (and all physical objects associated with the treasure hunts) are located in public areas. Trespassing or otherwise entering any prohibited area, trespassing or otherwise entering any area after posted hours, digging or otherwise disturbing any land in any way, and vandalizing or altering fences or other structures are all strictly prohibited activities.
  3. The use of methods other than using, examining, and interpreting the official treasure hunt materials to complete any treasure hunt or any part of our Service is strictly prohibited. Contestants may not engage in conduct that we deem to be against the spirit of treasure hunts which includes, but is not limited to: any form of cheating; dissemination of disinformation to other Contestants; unauthorized access of information through hacking or other means; tracking or stalking of any other Contestants or any of Treasurefix LLC’s directors, officers, members, employees, affiliates, agents, contractors, interns, suppliers, Service providers, or licensors, or any family members or other relations of any of the aforementioned individuals.
  4. Spamming or "brute-force attacking" any treasure hunt with excessive solve submissions is prohibited, as is knowingly submitting solve attempts without a valid and active Unique Solve ID (when a treasure hunt requires a valid and active Unique Solve ID, as is most of the case). Any such conduct, within our sole discretion, may result in the suspension and/or termination of your membership and/or your ability to submit solves. While we will likely provide a warning pertaining to any such activity before taking action, we reserve the right to implement an immediate suspension or termination if the situation calls for it, within our sole discretion. A good rule of thumb to follow is to only submit solve attempts that you have a reasonable, good faith basis to believe may be correct, and to only do so when you are reasonably certain that your Unique Solve ID is valid and active.
  5. Any conduct that is illegal within the jurisdiction of the location of the treasure hunt or any physical objects associated therewith (whether the law prohibiting the conduct be local, state, or federal and regardless of whether such law is routinely enforced) is strictly prohibited, irrespective of whether investigated by the police or other duly constituted authority or if charges are ultimately filed. Said violations include, but are not limited to, traveling in excess of posted speed limits, reckless driving, impaired driving, and trespassing.
  6. To assure the integrity of our Service for all Contestants, we will not provide warnings of any kind prior to a Contestant losing his/her eligibility because he/she has engaged in prohibited conduct.

F. Miscellaneous:

  1. We may cancel a treasure hunt or any part of our Service for any reason beyond our control; a force majeure event (e.g., a natural disaster, pandemic/epidemic, civil commotion, riot, strike, act of fraud, etc.). In the event of a treasure hunt or any part of our Service being cancelled (“cancelled” defined here as the treasure hunt ending without an Official Winner being determined and announced by Treasurefix LLC), Contestants will not be eligible to receive a full or partial refund for any membership product for which they are currently subscribed.
  2. Treasurefix LLC is not responsible for any expenses incurred by Contestants other than the cost of membership products purchased through our website or mobile applications.
  3. All decisions by Treasurefix LLC are final and binding in all respects and not subject to appeal, including but not limited to those decisions specifically made subject to an Official Dispute.
  4. Treasurefix LLC reserves the right to revise these Official Rules or add additional rules at any time prior to launch of a given treasure hunt or any part of our Service, in the event of unforeseen behavior or circumstances.

SECTION 14 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable, or to your liking.You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.In no case shall Treasurefix LLC, our directors, officers, members, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 15 - INDEMNIFICATION
